Thomas Charles White ('Mr White') failed to ensure that Whiteworks Projects Ltd ('WPL') complied with its statutory obligations to make payments when due to HM Revenue & Customs ('HMRC') for VAT and PAYE/NIC/CIS. As a consequence he caused WPL to trade to the detriment of HMRC from at least 07 October 2015 when VAT for August 2015 fell due, to its dissolution in February 2018, resulting in a liability to HMRC of at least £151,148 for unpaid taxes. In that:
WPL was registered for VAT in December 2014 and it filed returns for the quarters ended February 2015 to May 2017 (of which February and May 2015 were nil returns);
Returns were prepared, but not filed, for the quarters August and November 2017;
A total of £105,726 fell due for VAT up to November 2017, against which only 2 payments were made, in July 2016 and July 2017, totalling £9,822;
At the liquidation date VAT of at least £95,904 was due dating from the quarter ended August 2015, which should have been settled by 07 October 2015;
PAYE/NIC/CIS was not paid on time from the first return submitted, November 2014;
At the liquidation date a total of £55,244 was outstanding, dating from the tax year 2016/17;
The accounts to 31 July 2015 and 31 July 2016 show no trade creditors (although 'other creditors' were owed £11,000 in 2015) and that HMRC was owed £19,003 and £67,611 respectively;
By the date of the liquidation there were no creditors other than HMRC, which has claimed £203,395;
Bank statements show payments of £623,842 from 03 January 2017, of which £31,365 was paid to HMRC.
