On 4 August 2020, Everton Alexander Graham James (“Mr James”) caused V A D Engineering Limited (“VAD”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, which resulted in VAD obtaining a BBL that was £22,640 more than it was entitled to. Between 6 August 2020 and 4 November 2020, Mr James also caused VAD to transfer £44,052 to his personal bank account and has failed to provide any evidence to show that the funds were used for VAD’s economic benefit. In that: In accordance with the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. The BBL funds were to be used for the economic benefit of the business that applied for the loan and not for the personal benefit of its director. VAD was incorporated on 7 June 2012. On 4 August 2020, Mr James applied for a BBL of £50,000 on behalf of VAD declaring that its turnover for the calendar year 2019 was £205,000. VAD received the BBL funds of £50,000 on 5 August 2020. Analysis of bank statements shows turnover of £109,440 for the calendar year 1 January 2019 to 31 December 2019. By overstating the turnover on the BBL application, Mr James caused VAD to receive £22,640 more than it was entitled to. Between 6 August 2020 and 4 November 2020, Mr James caused VAD to transfer £50,000 to his personal bank account of which £44,052 were BBL funds. Mr James has failed to provide any evidence to show that the funds were used for VAD’s economic benefit. Total liabilities at liquidation/administration amount to £62,338 of which £41,126 relates to the amount owed in respect of the BBL.
