On 20 May 2020, Julian Richard Brooks (“Mr. Brooks”) caused JRBROOKS&CO Limited (“JRB”) to make a Bounce Back Loan (“BBL”) application of £50,000 when he knew or ought to have known that JRB was not entitled to the loan. Mr. Brooks made a wrongful declaration by overestimating JRB’s turnover, as a result JRB has received BBL funds of £50,000 that it was not entitled to.?In addition, Mr Brooks has failed to provide evidence that the proceeds of BBL were used in their entirety for the economic benefit of the business as required under the terms of the BBL scheme. In that: ?? Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover.?? ? JRB was incorporated on 07 December 2018 and was therefore required to use turnover for the full calendar year of 2019. ? On 20 May 2020, Mr. Brooks applied for a BBL of £50,000 on behalf of JRB. On the BBL application Mr. Brooks signed, he gave JRB’s turnover for the 2019 calendar year as £300,000. JRB’s professionally prepared accounts for year-end 31 December 2019 which were subsequently filed at Companies House show that JRB was a dormant company. ?? On 21 May 2020, JRB received BBL funds of £50,000.?? On 14 September 2020 and 05 October 2020, JRB made two payments totalling £17,828 to two financial institutions. Mr. Brooks has confirmed that these payments were made to clear two personal loans. No repayments were made towards the BBL as and when due resulting in a £50,000 liability at Liquidation on 26 April 2022. Total liabilities at Liquidation amount to £50,100 of which £50,000 relates to the amount owed in respect of the BBL.?
