Between 22 July 2016 and 30 January 2018 Marc Ashton Smith (“Mr Smith”) caused Green Heating Services Ltd (“Green”) to trade to the detriment of HM Revenue and Customs (“HMRC”) and that from, at the latest, June 2017 such trading was carried out at a time when Mr Smith was aware that Green was insolvent and unable to pay its debts, resulting in a debt of at least £113,875 plus penalties, interest and other charges of £1,880 to HMRC at liquidation in that: • Between 22/04/16 and 22/02/18 Green became liable to pay £103,468 to HMRC in respect of PAYE/NIC and CIS; • Between 13/07/16 and 09/03/17 Green paid £13,200 to HMRC on account of its PAYE/NIC/CIS liabilities; • Leaving PAYE/NIC/CIS liabilities totalling £90,268 unpaid for the period 06/04/16 to 05/02/18 which should have been paid between 22/07/16 and 22/02/18; • Green was required to submit a VAT return for the year ended 30/04/17 and make payment in full of the amount due by 30/06/17; • Green was required to make instalment payments of £3,295 each on account of its VAT liability for the year ended 30/04/18 on 31/08/17, 30/11/17 and 28/02/18 and to submit a VAT return for the year ended 30/04/18 with payment of the balance due by 30/06/18; • Green did not submit the VAT returns for the years ended 30/04/17 or 30/04/18 and did not make any payments to HMRC on account of its VAT liabilities; • On 17/07/17 HMRC issued a VAT assessment in the sum of £13,180 for the year ended 30/04/17 which remains unpaid; • On 13/04/18 HMRC issued a VAT assessment in the sum of £10,427 for the period ended 28/02/18 which remains unpaid; • In addition Green owes £1,880 to HMRC in respect of penalties, interest and other charges; • By, at the latest, June 2017 Mr Smith was aware that Green was insolvent and unable to pay its debts. Between then and liquidation Green’s liabilities to HMRC increased by at least £65,045 from £50,710 to £115,755; • At liquidation the only other disclosed creditor was a debt of £19,000 due to Mr Smith which is not evidenced; • At liquidation HMRC are owed £123,033 which includes VAT assessments and a surcharge in respect of periods post cessation of trade. Marc Ashton Smith (“Mr Smith”) failed to ensure that Green Heating Services Limited (“Green”) maintained and/or preserved adequate accounting records for the period 16 December 2015 to 30 January 2018 or, in the alternative, failed to deliver up to the Official Receiver such records as were maintained for that period. As a consequence of that failure the Liquidator has been unable to: • Confirm the nature of Green’s trading activities • Establish the source and extent of Green’s turnover • Establish the extent of and reason for Green’s expenditure • Establish the true extent of Green’s VAT liabilities for the period May 2016 to January 2018 • Establish the balance due to or by a connected company resulting from inter-company dealings • Establish Green’s liability, if any, to HMRC in respect of Corporation Tax.
