That Philip James Robinson (“Mr Robinson”) caused Diamond Geezer Ltd (“Diamond Geezer”) to trade at the risk of HMRC and to their ultimate detriment between 01 November 2015 and 16 June 2017, the date of liquidation (“the period”). During the period Mr Robinson or his co-director received payments totalling £333,237 of Diamond Geezer’s total income of £401,367, meanwhile Diamond Geezer paid £10,000 to HMRC and at the date of liquidation HMRC was owed £143,366 in respect of VAT and Corporation Tax. Mr Robinson also failed to ensure that Diamond Geezer met its statutory obligations to make full and timely payments to HMRC in respect of VAT and Corporation Tax: HMRC: • On 31 October 2015 Diamond Geezer’s combined VAT and Corporation Tax liability totalled £8,561 and this increased to £143,366 at the date of liquidation. VAT: • On 01 November 2015 Diamond Geezer’s VAT liability totalled £1,658. Thereafter Diamond Geezer filed 3 VAT returns recording a total liability of £25,144, with a further £31,655 added as a result of 3 assessments. Furthermore, Diamond's failure to submit a return for the April 2017 period, caused HMRC to issue a final assessment for £9,933, The liability was increased further by surcharges totalling £10,010. • During the period Diamond Geezer made payments to HMRC in respect of VAT totalling £0. • Diamond Geezer’s VAT liability at liquidation totalled £78,399 inclusive of surcharges applied as a direct consequence of the failure to pay totalling £11,677. Corporation Tax: • On 31 October 2015 Diamond Geezer’s CT liability totalled £6,903. Thereafter Diamond Geezer filed 2 CT returns recording a total liability of £65,654 and made payments to HMRC in respect of CT totalling £7,590. Diamond Geezer’s CT liability at liquidation totalled £64,967. • The CT liability for the year ended 31st January 2015 totalled £45,147 and was due for payment on 1st November 2015. • The CT liability for the year ended 31st January 2016 totalled £20,508 and was due for payment on 1st November 2016. Benefit to directors and detriment to HMRC: • Bank analysis demonstrates that from 01 November 2015 to 16 June 2017 Diamond Geezer received net payments into its bank account of £401,367 and made net payments from its account totalling £406,019. Of the income received, Mr Robinson or his codirector received £333,237, HMRC received £10,000, other creditors listed at liquidation received £11,026, a Commercial Credit Card received £24,859 and other payments totalled £26,897.
